<list> <ul> <li> commands ?

Nobody ever made or makes a <list> <ul> <li> menu not even in HTML4, but I guess you meant <nav> <ul> <li>. There is coming a <menu> <menuitem> but probably in HTML6... hehe

I guess you can use divs if you're so inclined, but why?

You can use CSS to make any element look the way you want. It comes down to HTML 5 being about semantics ... the tags you use explain the purpose and greatly assist search engine bots, blind people, etc.
